A sole proprietorship exporting services should, for now, assume it must file the monthly EDF. RBI's 7 October 2026 statement said individuals providing services abroad are not required to report, but a proprietorship is a business, and until RBI's promised FAQs say otherwise, the safer course is to file. In practice that means one EDF a month to your AD bank, showing your trade name, your own PAN, and your signature as proprietor.
Key takeaways
- Legally, a proprietorship and its owner are the same person; for EDF purposes, the question is whether you act as a business or on personal contracts.
- RBI's comments on 7 October 2026 concerned individuals and personal-contract transactions; FAQs are awaited.
- Until the FAQs are out, proprietors trading under a business name, with GSTIN or a current account, should file.
- Use the proprietor's PAN, the business GSTIN if any, and sign Part 4 as "Proprietor".
- If you are genuinely in the grey zone, filing costs little; not filing can cost more.
The grey area, stated plainly
At RBI's policy press conference on 7 October 2026, the Governor said individuals providing services abroad, such as tutoring or small software work, are not required to report. The Deputy Governor said personal-contract transactions are outside the reporting requirement. RBI said it would issue FAQs. The text of the Foreign Exchange Management (Export and Import of Goods and Services) Regulations, 2026 has not changed.
A proprietorship has no separate legal identity: the business is the proprietor. So is a proprietor an "individual"? Possibly, in some situations. But a proprietor running a trading business with a name, staff, a current account and GST registration looks much more like a business than a person on a personal contract. Until the FAQs draw the line, treat yourself as covered and confirm with your bank.
Where you probably sit
| Your situation | Suggested approach until FAQs |
|---|---|
| Freelancer in own name, savings account, no GSTIN | Closer to the individual case; check with bank |
| Trade name, current account in that name | File the EDF |
| GST-registered, export invoices under LUT | File the EDF |
| Employ staff or subcontractors | File the EDF |
| Mixed: some personal gigs, some business invoices | File for business invoices; ask bank about the rest |

Filling the EDF as a proprietor
Most of the form is the same as for any exporter. A few fields need proprietor-specific care.
| Field | What to enter |
|---|---|
| 1.7 IE code | Your IEC if you have one |
| 1.8 GSTIN | Your business GSTIN, if registered |
| 1.9 PAN | The proprietor's own PAN |
| 1.11 Exporter name and address | Trade name, with "Proprietor: [Your name]" if the bank prefers |
| 1.6 / 1.10 AD code and bank | The branch where export proceeds arrive |
| Part 4 | Keep "I" or "We" consistently; sign as "Proprietor, [Trade name]" |
The exporter name should match your bank account name. If your account is "Asha Rao trading as Lotus Prints", use that style rather than just "Lotus Prints".
On "I" or "We" in the declaration, either is defensible for a proprietor. Many keep "We" when signing for the business; others keep "I" because it is literally one person. Pick one and stay consistent.
Who signs, and what if you are away
The proprietor signs. If you want someone else, such as your accountant or a family member who manages the business, to sign or submit on your behalf, check with your bank whether it accepts an authority letter for this purpose. Our authority letter for bank template can help, but the bank decides what it will accept.
A worked example
Ramesh Iyer runs "Iyer Technical Translations", a GST-registered proprietorship in Chennai, translating engineering manuals for German and Japanese clients. He has a current account in the trade name and two part-time translators.
In December 2026 he raised:
| Invoice | Date | Client country | Amount |
|---|---|---|---|
| ITT/26/48 | 4 Dec 2026 | Germany | EUR 1,850 |
| ITT/26/49 | 11 Dec 2026 | Japan | USD 2,300 |
| ITT/26/50 | 22 Dec 2026 | Germany | EUR 640 |
Given his trade name, current account, GSTIN and staff, Ramesh files one December EDF with three rows by 30 January 2027. He uses his own PAN in field 1.9, the business GSTIN in 1.8, names the exporter as "Iyer Technical Translations (Proprietor: Ramesh Iyer)", and signs Part 4 as proprietor.
Each invoice is below ₹10 lakh, so once paid, he closes the EDPMS entries through a quarterly declaration of realisation with our realisation declaration tool.
Tax and GST stay the same
The EDF is a FEMA declaration. For a proprietorship, business income is taxed in the proprietor's personal return. GST export rules apply as usual: zero-rated when the Section 2(6) IGST Act conditions are met, typically under an LUT, with "Supply meant for export under LUT without payment of IGST" on the invoice. Nothing about the EDF changes those obligations.

Frequently asked questions
Does a sole proprietorship need to file the EDF?
Until RBI publishes its FAQs, proprietorships exporting services should assume they are covered and file. RBI's 7 October 2026 statement concerned individuals and personal-contract transactions, while a proprietorship trading under a business name usually looks like a business.
Which PAN does a proprietorship use on the EDF?
The proprietor's own PAN, because a proprietorship does not have a separate PAN. Use the business GSTIN in field 1.8 if you are GST-registered, and your IEC if you have one.
Should a proprietor use "I" or "We" in the EDF declaration?
Either is defensible, since a proprietorship is one person running a business. Choose one, stay consistent with how you name the exporter in Part 1, and sign as "Proprietor, [Trade name]".
Can someone else sign the EDF for my proprietorship?
The proprietor normally signs. If you want another person to sign or submit on your behalf, ask your bank whether it accepts an authority letter for this purpose and follow its requirements.
I freelance in my own name without a business set-up. Am I a proprietorship?
You may be closer to the individual case RBI described on 7 October 2026. Factors like a trade name, GST registration, a current account and staff point towards a business. Check with your bank until the FAQs clarify the position.
Bottom line
For proprietors, filing the EDF is the low-risk choice while RBI's FAQs are pending. Prepare each month's form with our free EDF form generator, using your own PAN and your trade name.
