EDF for Clinical Research Organisations (CROs): Export Declaration Guide

Indian CROs that bill foreign sponsors for trial management, data management, biostatistics, medical writing or pharmacovigilance declare those invoices on a monthly EDF. The challenge for CROs is not the form but the billing model: long studies, milestone fees tied to enrolment, and investigator or site costs passed through to sponsors. Each export invoice still gets one row, and each carries its own nine-month realisation window.

Key takeaways

  • Every export invoice to a foreign sponsor or foreign CRO partner goes on the EDF for the month it is raised.
  • Purpose code P1008 covers research and development services; confirm the right SAC code under the R&D group with your CA.
  • Milestone invoices tied to enrolment or database lock each get their own row and deadline.
  • Pass-through costs invoiced to the sponsor are export invoices too; keep them clearly labelled.
  • Sponsor payment cycles can be slow; track every invoice against its nine-month date.

Which CRO services count as exports

A CRO in India serving a sponsor abroad might provide several kinds of service:

  • clinical trial project management and monitoring
  • clinical data management and biostatistics
  • medical writing and regulatory document preparation
  • pharmacovigilance case processing
  • bioanalytical or laboratory services (check whether any element is goods)

Where the sponsor is outside India and the service is supplied to it, these are exports of services. Under the Foreign Exchange Management (Export and Import of Goods and Services) Regulations, 2026, such invoices go on the EDF: to the AD bank for units outside an SEZ, or to the SEZ Development Commissioner for units inside one.

Some CROs work as subcontractors to a global CRO rather than directly for a pharmaceutical sponsor. That does not change the EDF: your recipient is whoever you invoice, and their country goes in the Part 2B country column.

Codes for clinical research work

Purpose code. P1008 is the RBI purpose code for research and development services, which fits much of what CROs do. Data management or software-heavy work might be coded differently. Agree the code with your bank and ask your sponsor's finance team to describe payments consistently. The purpose code finder lists the common options.

SAC code. R&D services have their own group in the GST services classification. Ask your CA to confirm the six-digit code for each service line, since medical writing, data management and pharmacovigilance may not all sit under the same code. Where the work is mainly IT, such as building an electronic data capture system, codes like 998314 may come into play.

Billing models and how they show up on the EDF

Billing element Typical trigger EDF treatment
Start-up fee Contract signature or site activation One row in that month's EDF
Monthly management fee Each month of the study One row per monthly invoice
Unit fees Per patient enrolled, per visit, per case processed Each invoice a row; quantities in description
Milestone fee First patient in, last patient out, database lock One row in the month the milestone invoice is raised
Pass-through costs Site payments, couriers, translations recharged One row per invoice; label clearly

The thing to avoid is billing pass-throughs months after they were incurred and then struggling to match a large mixed payment. Invoicing pass-throughs monthly, on their own invoice, keeps the EDF and the bank's matching tidy. Whether pass-throughs form part of your taxable value for GST is a separate question for your CA.

A worked example

Aarogya Clinical Services Pvt Ltd, a Hyderabad CRO, is running a Phase III study for a sponsor in Switzerland and handles pharmacovigilance for a US company. In March 2027 it raises:

Invoice Recipient Country Description Currency Amount
ACS/26-27/612 Sponsor Switzerland Study management fee, March 2027 CHF 38,000
ACS/26-27/613 Sponsor Switzerland Milestone: last patient in CHF 55,000
ACS/26-27/614 Sponsor Switzerland Pass-through site costs, Jan–Mar 2027 CHF 21,700
ACS/26-27/615 Biotech USA PV case processing, 840 cases USD 16,800

All four go on Aarogya's March 2027 EDF, due by 30 April 2027. Several invoices are above ₹10 lakh in rupee terms, so when payment arrives Aarogya will give the bank invoices, payment evidence and matching instructions for those.

The milestone invoice, dated 24 March 2027, must be realised by 24 December 2027. If the sponsor pays on a quarterly cycle, that is fine, but Aarogya flags any invoice still unpaid at month six for escalation.

Long studies and the nine-month rule

Clinical studies run for years; the realisation clock does not. Each invoice must be realised within nine months of its date (twelve months if invoiced and settled in rupees). The AD bank can extend that period on a reasoned request.

Practical habits that help CROs:

  1. Invoice promptly when a milestone is met rather than waiting for a quarterly cycle.
  2. Agree payment terms in the master services agreement that sit well inside nine months.
  3. Keep sponsor disputes over pass-throughs separate from undisputed fees, so one argument does not hold up everything.
  4. If a sponsor reduces an invoice, issue a credit note and tell your bank, so the EDF value and realisation agree.
  5. Seek an extension in writing before the deadline if a payment will be late but is genuinely coming.

GST, confidentiality and records

Export of services is zero-rated where the Section 2(6) IGST Act conditions are met. Most CROs export under an LUT, printing "Supply meant for export under LUT without payment of IGST" on export invoices. Clinical work sometimes involves services performed on goods or at sites in India, which can raise place-of-supply questions; discuss your study structures with your CA. This article is general information, not legal or tax advice.

Use protocol numbers or internal study codes in EDF descriptions rather than drug names or patient details. Keep the master services agreement and each work order referenced in the contract column. Our article on milestone billing for export projects has more on structuring milestone invoices.

Frequently asked questions

Do CROs need to file the EDF for sponsor invoices?

Yes. A CRO exporting services to a foreign sponsor or foreign CRO partner declares each invoice on a monthly EDF, filed with its AD bank, or with the SEZ Development Commissioner for SEZ units.

Which purpose code should a CRO use?

P1008 covers research and development services and suits much clinical research work. Data management or software work may be coded differently. Confirm with your bank and check each FIRA.

Should pass-through site costs go on the EDF?

If you invoice the foreign sponsor for them, those invoices are part of your export billing and belong on the EDF. Label them clearly and ask your CA how they are treated for GST.

How do I handle a milestone that is invoiced but disputed?

The invoice stays open in EDPMS until realised. If the amount is reduced, issue a credit note and inform your bank. If payment will be late, request an extension before nine months from the invoice date.

Can I use the study protocol number in the description?

Yes. A protocol or internal study code identifies the work without revealing confidential details such as drug names. Pair it with the service type, for example "data management, protocol ABC-301".

Bottom line

For CROs, the EDF works best when invoices follow the study's milestones closely and pass-throughs are billed on their own. Set codes once with your CA and bank, track each invoice's deadline, and prepare the monthly form with the free EDF form generator.
